The Superior Court of the Federal Territory of the Capital (FCT) has canceled the arrest warrant for Mohammed Bello Adoke, former federation attorney general, Dan Etete, former oil minister and four others in the OPL 245 / Malabu case.
On Friday, in a ruling, Danlami Senchi, the judge, canceled the arrest warrant issued on 17 April 2019.
The judge canceled the arrest warrant claiming that the court had no jurisdiction to issue orders and that the defendants had not received the information charge at the time the order was issued.
However, efforts to get the court to eliminate the names of the defendants from 4 to 9 of the charge were interrupted because the judge rejected the sentence.
Through Mike Ozekhome, his lawyer, Adoke had previously asked the court to cancel the order in which the court had been deceived.
He also asked the court to delete his name in the lawsuit filed by the federal government against Shell Nigeria Exploration Production Company Limited and 10 others.
Ozekhome had stated that Adoke’s arrest warrant had been issued in violation of his right to a fair trial, as guaranteed by the Constitution, adding that Adoke had received neither the accusation sheet nor the evidence nor other evidence. citation related to the criminal charge pending before the court.
He stated that the arrest warrant of the former AGF was issued without jurisdiction and should be canceled.
